The terms that apply when you use our website or engage us for a project.
These terms apply to your use of our website and to any services we provide. Where we have a signed written quote or service agreement with you, that document takes priority if there is any inconsistency.
01 About these terms

02 Quotes and scope of work
We provide a fixed written quote in Australian dollars after a discovery call. The quote sets out the scope, deliverables, timeline and payment terms for your project.
Anything not listed in the quote is out of scope. Additional work can be added by written agreement and may affect the price and timeline.
Quotes are valid for [INSERT NUMBER] days from the date of issue unless stated otherwise.
03 Fees, payment and GST
Unless your written quote says otherwise:
- All prices are in Australian dollars (AUD) and GST status is stated on the quote and invoice
- A deposit of [INSERT %] is payable before work begins
- Invoices are payable within [INSERT NUMBER] days of the invoice date
- Third-party costs (hosting, domains, licences, ad spend, stock assets) are billed separately or paid directly by you
- We may pause work on overdue accounts after giving you written notice
04 Your responsibilities
To keep your project moving, you agree to:
- Provide content, assets, access and approvals within agreed timeframes
- Ensure you own or have permission to use any content you supply to us
- Give timely feedback at each review stage
- Nominate a single point of contact for decisions
05 Intellectual property and ownership
On full payment of all invoices for a project, ownership of the final deliverables transfers to you. This includes your domain, hosting account, website or application code, creative source files, ad accounts and data.
We retain ownership of our pre-existing tools, frameworks, libraries and internal know-how used to build the deliverables. You receive a perpetual licence to use these as part of your deliverable.
Unless you tell us otherwise in writing, we may reference your project in our portfolio and case studies.
06 Third-party services
Projects often rely on third-party platforms such as hosting providers, payment gateways, advertising platforms, CRMs and plugins.
Those services are governed by their own terms and pricing. We are not responsible for outages, policy changes, price increases or account suspensions caused by third parties.
07 Confidentiality
Each party agrees to keep the other party’s confidential information private and to use it only for the purpose of the project.
This obligation continues after the project ends. It does not apply to information that is already public or that we are required by law to disclose.
08 Warranties and Australian Consumer Law
We will provide our services with due care and skill, and within a reasonable time.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes those guarantees.
We provide a [INSERT NUMBER] day defect period after launch, during which we will fix bugs in work we delivered at no charge. This does not cover new features, content changes, or issues caused by third-party updates or changes made by others.
09 Limitation of liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, our total liability arising out of or in connection with a project is limited to the fees you have paid us for that project.
We are not liable for indirect or consequential loss, including loss of profit, revenue, data or business opportunity.
10 Termination
Either party may end an engagement by giving written notice. If you end a project early, you remain liable for work completed and costs already committed up to the date of termination.
On termination, we will hand over completed deliverables for which payment has been received, along with access and documentation.
11 Website content and availability
We try to keep the information on this website accurate and up to date, but we do not guarantee that it is complete or error-free.
We may change, suspend or withdraw any part of the website at any time without notice.
12 Governing law
These terms are governed by the laws of [INSERT STATE OR TERRITORY], Australia. Both parties submit to the non-exclusive jurisdiction of the courts of that state or territory.
